With over 27 years of professional experience, he specialized in Labour Law. He was the Labor Relations Manager of Chiquita Guatemala, Limited Company (Chiquita Brands International) for three years. Luis Enrique worked as an employer advisor in collective agreements on working conditions for more than six years in the agricultural industry for Chiquita Brands International in Guatemala.

 

He worked as an external consultant providing labour advice and in the judicial and extrajudicial resolution of conflicts between collective and individual labour for Chiquita Brands International in Guatemala for more than 15 years. He also provided labour advice as an external consultant to companies that provide services in the telecommunications sector.He has also dedicated himself for more than 27 years to Litigation in Administrative Law, Constitutional Law and Tax Law for companies in the telecommunications and tobacco sectors.

 

Likewise, for over 25 years, he has dedicated himself to teaching Individual Labor Law, Collective Labor Law, and Individual and Collective Labor Procedural Law at prestigious universities in Guatemala as the Francisco Marroquín University (1996 to 1998 and from 2004 to 2005) and at the Rafael Landívar University (2000 and from 2006 to date).

Outstanding Experience

  • As Labor Relations Manager and as an external consultant for Chiquita Guatemala, he provided labour advice on collective bargaining and for the resolution of conflicts, where 11 unions were involved and the presence of more than 2,000 workers.
  • From 2018 to 2022, he was in charge of the employer’s defence of a telecommunications company in more than 30 ordinary labour trials without a conviction being handed down in any of these processes.
  • Disappearances in the administrative and judicial instance of tax adjustments in matters of tobacco tax for an approximate amount of US $ 12,000,000.00.
  • Preparation, approach and processing in all instances of 166 contentious administrative processes promoted against the Tax Administration for excessive payment of the tobacco tax, claiming the restitution of the tax paid in this regard: an approximate amount of US$ 10,200,000.00 in favour of the client as a refund of tax paid in excess.
  • As a litigation lawyer in Constitutional Law, from 2018 to 2022, he prepared, raised and processed, obtaining favourable sentences in more than 13 actions of general unconstitutionality promoted against municipal agreements that set charges for telecommunications infrastructure.
