Virginia Servent Palmieri is Partner and Intellectual Property Director at Lex Atlas.

Virginia’s career is focused on advice related to the protection and defence of intellectual property, from prevention to the defence of infringed rights, with extensive experience in the fight against piracy and counterfeiting, commercial litigation, conciliation processes, mediation and arbitration. 

She has over 20 years of professional practice with master’s studies in Commercial Law and Competitiveness, a master’s degree in Digital Risks and Cybersecurity, private practice in renowned law firms and multinational companies, and more than six years of experience in the entertainment industry.

Throughout her professional practice, she has completed legal audits focused on litigation, intellectual property and related contracts; advice, analysis, review and preparation of license, franchise, distribution, assignment of rights and other similar agreements.

She has skills in negotiation and conciliation, economic transactions, implementation of awareness and education projects on intellectual property, and training on intellectual property for the judicial and administrative sectors.

Outstanding Experience

  • Legalization of one of the largest cable television operators in Central America that were retransmitting the television signals owned by the FOX NETWORKS GROUP for more than five years, signing a 5-year contract, as well as a debt acknowledgement for the five years for unauthorized retransmission. The contracts were fulfilled.
  • Through the management of the Anti-Piracy department under her charge in the region at Fox Networks Group, an increase in the company’s revenues was obtained for the Central American and Caribbean region, by 42%, and in Mexico, by 1 %.
  • Direct participation in the actions that managed to stop the launch of a website that was promoted as the Netflix of sports through in-depth research into the offer and close collaboration with the entertainment industry involved, as well as through the efficient intervention of the Mexican authorities of the Mexican Institute for Industrial Property (IMPI), who ex officio initiated the corresponding legal actions.
  • Structuring an awareness and education program aimed at primary school children through the Company’s Public Relations department became LA LIGA ANTIPIRACY, an educational project promoted as part of the social responsibility program. In the program participated employees of the entire company, in a system of educational volunteering, who travelled through Argentina, Guatemala, Chile and Peru in several private schools in each country, raising awareness among thousands of primary school students on intellectual property protection. She restructured the intellectual property department through the elaboration of an inventory of files that would allow her to give the ideal follow-up to each one.
  • Reorganization of a department of Intellectual Property in Guatemala in a renowned regional firm, dividing it into areas according to the strength of each team member to carry out a better order and structure of each registration process, with managers in each process area, achieving efficient management of new files.
  • Resolution of several contentious conflicts through out-of-court settlements at zero cost.
  • Management and processing of the investigation, prosecution and execution of a judicial process within which it was possible to dismantle a clandestine chlorine factory, achieving a conviction.
  • Development and structuring of the Intellectual Property Department of Asensio, Andrade & Asociados in 1998, positioning it as one of the leading Intellectual Property firms in Guatemala as well as one of the leading intellectual property litigation firms.
